Many people worry about their care provision later in life, and the uncertainty can make you feel vulnerable. We put people in control of the care they receive by ensuring your wishes are taken into consideration and that those people close to you have the appropriate legal powers to meet your care needs. We can help secure better care arrangements to ease the worries of later life, supporting you to put more efficient plans in place to assist in meeting your care costs.
We can put in place a Lasting Power of Attorney, a Living Will and Court of Protection documents or undertake prompt assessments for mental and physical capacity.
Lasting Powers of Attorney (LPA) are important documents that enable you to choose who will handle your affairs and make decisions on your behalf if you are no longer able to do so due to either a short or long-term incapacity. There are two types of LPA - Property and Financial Affairs LPA and Health and Welfare LPA. The latter allows you to express your wishes regarding medical treatment and/or care and enables the people you trust to make decisions based on these wishes if you are unable to. Preparing LPAs ahead of needing them will allow you to decide who is appointed to act on your behalf and discuss your wishes with them.
If an individual has started to lose or has lost mental capacity, it can be very difficult for their family to help them and make decisions concerning their finances and welfare if they do not have an LPA in place. In this scenario, we can provide advice and assist in relation to Court of Protection applications, and, if necessary, we can prepare an application to appoint a Deputy to look after family members, or friends’ finances and property.
