Landlords quite often do not realise that every time they receive any money from a tenant which forms all or part of a deposit, they must protect it by registering it with a government-backed tenancy deposit scheme and provide the prescribed information to tenants within 30 days of receiving it.  This often creates a problem when landlords face difficulties with a tenant, for example when they have fallen behind on their rent.  The consequences of not protecting the deposit are that the landlord may have to pay back the deposit and up to three times the monthly rent and they are not able to serve certain notices in the procedure leading up to gaining possession of the property.

We can provide advice from the outset to avoid problems of this nature and we can also help minimise the effect if a landlord has failed to protect the deposit. We can also prepare Tenancy Agreements which will protect landlords so that they have greater powers and better protection.
